Terms and Conditions of the tuduu.it Marketplace

Premises

These General Conditions govern the use of the Tuduu digital platform (hereinafter, the "Platform" or the "Marketplace"), accessible at https://tuduu.it and managed by Drilldown S.r.l., with registered office in Milan, Viale Isonzo 8, C.F./P.IVA 12392590969 (hereinafter, "Tuduu" or the "Company").

Through the Platform, Tuduu allows users (hereinafter, the "Users") to browse and purchase food products marketed by third parties (hereinafter, the "Sellers").

Tuduu operates as a digital marketplace, providing the technology necessary for the publication of catalogs, their internationalization through scalable technology, the enhancement of the user experience through the application of proprietary nutritional filters, up to the management of the cart, the payment process, and operational support. Tuduu is not a contractual party in the sale of products offered by the Sellers.

Role of the Platform

The Tuduu Platform exclusively hosts products offered by third-party Sellers, who act in full autonomy in managing their catalog, logistics, and commercial relationship with the User.

The sales contract is concluded directly between the User and the selected Seller.

Tuduu acts as a facilitator of the transaction, without owning the goods or assuming responsibility for their availability, quality, conformity, or suitability for use.

Purchase Methods

The Platform allows the User to compose one or more carts, each referring to a single Seller, and to complete the purchase directly on tuduu.it through secure payment systems.

The payment is collected by Tuduu as the entity appointed by the Seller, with automatic credit to the same, net of the agreed commissions.

The completion of the order is confirmed via email to the User and the Seller. The latter is responsible for managing the order, shipping, and post-sale assistance.

Invoicing / Payment Receipt

The invoice and/or payment receipt related to the purchase is issued directly by the Seller, based on the tax data provided by the User at the time of the order.

Tuduu is not responsible for any errors or omissions in the data entered, nor can it intervene in the fiscal management of the transaction.

Shipping, Delivery, and Assistance

The Seller is solely responsible for fulfilling the order, choosing the carrier, shipping timing, and communicating the tracking code where provided.

Any delays, delivery errors, damages, or shortages must be reported to the Seller, who is required to respond according to their general conditions.

Tuduu may provide a general assistance service to facilitate communication between User and Seller, without assuming direct responsibility.

Right of Withdrawal

The right of withdrawal is granted to the User within the limits provided by Legislative Decree 206/2005 (Consumer Code) and is exercised directly against the Seller.

The methods and terms of withdrawal are reported in the Seller's contractual documentation or can be requested through the contact form available on the Platform.

Tuduu's Responsibility

Tuduu assumes no responsibility regarding:

a) the truthfulness, completeness, or updating of the information provided by the Sellers; b) the actual availability of the products offered; c) the fulfillment of the order, delivery, and management of returns; d) post-sale assistance and any disputes between User and Seller.

Tuduu guarantees the correct technical functioning of the Platform, the reliability of the payment systems used, and the adoption of high security standards.

Contractual Changes

Tuduu reserves the right to modify these General Conditions at any time. The changes will take effect from the date of their publication on the tuduu.it website and will be deemed accepted by the Users with the continued use of the Platform.

Applicable Law and Jurisdiction

These General Conditions are governed by Italian law.

For any dispute that may arise between the Parties regarding the interpretation, validity, or execution of this document, the Court of Milan will have exclusive jurisdiction, without prejudice to the protection reserved for the User under the current consumer legislation.
